الملخص
يدرس هذا البحث جرائم التمييز وخطاب الكراهية التي نص عليها المشرع الجزائري في القانون 20-05 الصادر في 28 أفريل سنة 2020م، وحدّد فيه عقوباتها، ويهدفُ البحث إلى تحديد المقصود بالتمييز العنصري وخطاب الكراهية وبيان صورهما، وأسباب تجريمهما، وبيان جهود المشرع الجزائري في محاولة الحدّ من انتشار هذه الظاهرة، كما يهدفُ إلى تصنيف جرائم التمييز وخطاب الكراهية وبيان عقوباتها بتحليل بعض النصوص من القانون 20-05 المتعلق بها، وبيان الحالات الاستثنائية التي اعتبرها التشريع الجزائري في هاته الجرائم تشديدًا أو تخفيفًا، ومن أهم النتائج التي توصل إليها البحث أنّ التمييز هو كل تفرقة أو استثناء في الحقوق والحريات، ويقوم على أساس اللون أو النسب أو اللغة أو الانتماء أو الحالة الصحية، وخطاب الكراهية هو كل تعبير يوحي بذلك التمييز ويثير الكراهية بين الناس مهما كان شكله، وقد تصدّى المشرع الجزائري لهاته الظاهرة بإصدار قانون الوقاية من التمييز وخطاب الكراهية سنة 2020م، وبين فيه عقوبات التمييز والمشاركة فيه والتشجيع عليه، كما ذكر فيه حالات استثنائية؛ بعضها تُشدّد فيها العقوبة، وبعضها تُخفّف فيها، وبعضها يُعفى فيها الجاني من العقاب.
