The Verses of Legal Rulings in Works on Problematic Qur’anic Exegesis
Abstract
The study aims to examine the verses of legal rulings discussed in Dafʿ Iyhām al-Idtirāb, clarify their meanings, and present the objections raised by the author, followed by an analysis of the jurisprudential issues derived from them. It also seeks to address contemporary issues in light of the guidance and rulings of these verses. The significance of the research lies in its focus on the jurisprudential aspects of the verses and its integration of fiqh, Qur’anic sciences, and tafsīr, offering a multidisciplinary perspective. The research problem centers on the misunderstandings some may have regarding the legal rulings related to these verses. The study includes an introduction outlining its importance, questions, objectives, scholarly contribution, scope, methodology, and structure, followed by two sections: the first on the verses from Sūrat Āl ʿImrān and the second on those from Sūrat al-Nisā’. Using an inductive and analytical approach, the study concludes by resolving the objections raised by the author and examining the rulings of the verses, covering eight major issues. It also identifies contemporary matters addressed by these rulings, such as the dilution of Islamic identity through Western imitation, family issues like marital discord, social issues such as inheritance disputes, and legal matters that provide preventive safeguards for society. The study recommends dedicating independent research to verses of legal rulings that people commonly find problematic and linking them to contemporary issues within educational curricula.
