النظام القانوني للمحافظة العقارية في التشريع الجزائري
الملخص
يعتبر العقار من أهم الأشياء المملوكة للأشخاص ، و هو من أكثر الأموال دلالة على الثراء و الغنى ، ذلك تجد الأفراد يحاولون و يعملون قدر المستطاع للحفاظ عليه و حمايته بكل الوسائل حتى لا يتعرض للنهب و الاستيلاء و التخريب أو التعدي عليه من قبل الغير بالبيع ، لذلك وضع المشرع جهازا إداريا مهمته حماية العقارات الواقعة في دائرة اختصاصه و تسجيل و شهر كل التصرفات الواقعة عليها أو التي يجري التعامل فيها بخصوصها ، بالإضافة إلى تكليفه بتبليغ الغير المتعامل في العقار بكل ما يقع عليه ، هذا الجهاز هو المحافظة العقارية التي تعتبر الجهة الوحيدة المخولة بشهر كل ما يقع على العقارات الموجودة في دائرة اختصاصها .
